Online Casinos by State

Online casino rules in the United States are set state by state, not nationally. Real-money and sweepstakes play are tracked separately below, because they do not move together: 8 states license real-money play, while the sweepstakes column records a position in 14 and prohibition in 13 of them.

A dash means nobody has checked that vertical for that state yet — not that play is permitted. Each state page carries the regulator, the sources and the date its status was last verified.

More About Online Casinos by US State

The Federal Statute Points Back at State Law

The federal statute most often quoted in this area creates no licence of its own. The Unlawful Internet Gambling Enforcement Act defines unlawful internet gambling in terms of a bet or wager that is unlawful under any applicable Federal or State law in the State or Tribal lands in which the bet or wager is initiated, received, or otherwise made. It then carves out intrastate play: the exclusion applies where the bet or wager is initiated and received or otherwise made exclusively within a single State and is expressly authorized by and placed in accordance with the laws of such State. Both halves of that definition are about state law. Authorisation comes from a state, or from a tribe under federal Indian gaming law, so a reader looking for a federal answer to whether an online casino is legal will not find one: the question is not framed federally.

The Default Is Prohibition, Not Silence

State gambling statutes are generally written as a prohibition with exceptions, so a state that has not legislated for online casino gaming has not left it open. The Michigan Gaming Control Board states the structure for its own state in one sentence: gambling is generally illegal in Michigan unless it is specifically authorized by state law. That is why a state with no online casino statute is not described here as a grey market by default — silence in a statute of that shape is not permission — and why the question has to be asked of each state's own law rather than answered once for the country.

Where Online Casino Play Is Authorised, a State Agency Licenses It

Each state that has opened online casino gaming has named its own regulator in statute, and each of those regulators publishes who it has authorised. The Pennsylvania Gaming Control Board describes itself as an independent state agency tasked with protecting the public's interest through the regulation of casino and internet-based gambling, sports wagering, video gaming terminal gambling and fantasy sport games, created by the Pennsylvania Race Horse Development and Gaming Act of 2004 and charged with regulatory oversight of certain types of legalized gaming in the Commonwealth. The Michigan Gaming Control Board states that under the Lawful Internet Gaming Act, the Lawful Sports Betting Act and associated Michigan statutes, any entity offering online casino gaming or sports wagering to persons located within Michigan must be licensed and authorized by the MGCB, and that only those operators it licenses are authorized to legally offer online gaming services in Michigan. In New Jersey, the Division of Gaming Enforcement publishes the approved internet gaming sites and states that any site not included on the list is not approved to offer internet gaming in the State of New Jersey. Tribal gaming has its own federal overlay: the National Indian Gaming Commission was created in 1988 with the passage of the Indian Gaming Regulatory Act, to support tribal economic development through the operation of gaming on Indian lands.

The Published List Is the Check

These lists exist to be used, and the regulators say so. The Pennsylvania Gaming Control Board tells readers that before they bet they should use its links to verify that a site is PGCB regulated, and to look for the official board logo on all licensed operators' sites and materials. New Jersey states its position as an exclusion, which is the stronger form: a site absent from the list is not approved. Michigan publishes the operators and platform providers it has authorised and warns that its separate list of unlicensed platforms is not exhaustive and does not include all of them — so the authorised list, not the unauthorised one, is the one to read. The Michigan board also sets out what is missing on an unlicensed site: consumers who use illegal sites face the risk of unfair or manipulated games, withheld winnings, misuse of personal and financial data, and no meaningful avenue for dispute resolution.

A State Licence Does Not Travel

The federal carve-out is drafted around play that happens entirely inside one state, and the state regulators describe their own authorisations the same way: Michigan's applies to persons located within Michigan, New Jersey's to internet gaming in the State of New Jersey. A licence in one state therefore says nothing about a player in another, which is the state-level version of the point made across this site about national licences. It is also why licensed operators verify where a player is before accepting a wager.

How This Section Is Maintained

Status is held as data, per state and per vertical, each with its regulator, its source references and the date it was last verified. Real-money casino and sweepstakes are tracked separately and neither status is ever inferred from the other, because a state that licenses one has not thereby settled the other. Operator listings, where they exist, are built from the licensing links recorded between a state and each operator rather than written into prose, so a licence granted or withdrawn changes what is listed.
