Online Casinos in New York
New York does not allow online casino play. The state Constitution provides that no kind of gambling may be authorized or allowed in New York except state-operated lotteries, pari-mutuel betting on horse races, and casino gambling at no more than seven facilities, and the Penal Law makes it a class A misdemeanour to knowingly advance or profit from unlawful gambling activity, where unlawful means not specifically authorized by law. Online sports betting is a different matter: it is licensed under section 1367-a of the racing law, which bars any entity from making a mobile sports wagering platform available to people in New York unless licensed with the Gaming Commission. That licence is for sports wagering and does not extend to casino games. Sweepstakes casinos are banned outright: section 912 of the same law, added in December 2025, makes it unlawful to operate, conduct or promote online sweepstakes games in the state, with fines of ten thousand to one hundred thousand dollars per violation.
New York licenses online sports betting. It does not license online casino play, and the two are not the same authorisation. That distinction is the whole substance of this page.
What the Constitution Allows
New York's starting point is constitutional. Article I, Section 9 provides that, except as the section itself goes on to provide, no lottery or the sale of lottery tickets, pool-selling, book-making, or any other kind of gambling shall hereafter be authorized or allowed within the state. It then names the exceptions: lotteries operated by the state, with the net proceeds applied to education; pari-mutuel betting on horse races; and casino gambling at no more than seven facilities as authorized and prescribed by the legislature. The same provision requires the legislature to pass appropriate laws to prevent offenses against the section.
Online casino gaming is not among those exceptions, and the Penal Law makes that absence operative rather than merely silent. Section 225.00 defines gambling as staking or risking something of value on the outcome of a contest of chance or a future contingent event not under one's control, on an understanding that something of value will be received on a certain outcome, and it defines unlawful to mean not specifically authorized by law. A person advances gambling activity when, acting other than as a player, they engage in conduct which materially aids any form of gambling activity. Section 225.05 then makes it an offence — promoting gambling in the second degree, a class A misdemeanour — to knowingly advance or profit from unlawful gambling activity.
Online Sports Betting Is Not Online Casino
New York's mobile sports wagering sits in its own section of the Racing, Pari-Mutuel Wagering and Breeding Law. Section 1367-a provides that no entity shall administer, manage, or otherwise make available a mobile sports wagering platform to persons located in New York state unless licensed with the commission pursuant to that section. That is a licence to take wagers on sports events. It says nothing about slots, blackjack, roulette or live dealer games, and the legislature has not enacted an equivalent for them.
Anyone reading a list of states with legal online gambling should treat New York as a sports-betting entry only. A licensed New York sportsbook brand operating an online casino in another state does not make that casino lawful for a player in New York.
Sweepstakes Casinos Are Banned by Statute
New York is one of the states that has legislated against the sweepstakes casino model by name. S5935 of 2025, an act to amend the racing, pari-mutuel wagering and breeding law in relation to prohibiting online sweepstakes games and revenue from illegal markets, was signed as chapter 605 on 5 December 2025 and added section 912.
The definition is specific about the mechanism. An online sweepstakes game means any game, contest or promotion available on the internet or accessible on a mobile phone, computer terminal or similar access device, that uses a dual-currency system of payment allowing the player to exchange the currency for any cash prize, cash award or cash equivalents, or any chance to win one, and that simulates casino-style gaming, including but not limited to slot machines, video poker, table games, lottery games, bingo or sports wagering.
The prohibition reads that it shall be unlawful for any applicant, licensed entity, gaming employee, key employee, individual investor or investment firm, board member, or any other person or entity to operate, conduct, or promote online sweepstakes games within the state of New York. A person or entity found in violation is subject to a fine of not less than ten thousand dollars and not more than one hundred thousand dollars for each violation, and to the loss of a gaming licence or ineligibility for one. The state gaming commission, the state police, or the attorney general's office have the authority to enforce the section.
Enforcement has followed. The Attorney General's office states that Attorney General James stopped 26 illegal online sweepstakes casinos that offered slots, table games, and sports betting using virtual coins that could be exchanged for cash and prizes. A sweepstakes casino is not a licensed real-money casino, and the two are never presented here as alternatives to each other.
Unlicensed and Offshore Sites
This site does not name or recommend offshore or unlicensed operators in any market. New York enforces. In September 2026 the Attorney General and the Governor announced a lawsuit against a prediction market operator for running an illegal gambling operation, and the Attorney General's account of it notes that the operator had failed to obtain a license from the New York State Gaming Commission and advises people to ensure gambling platforms are registered with the Commission.
What This Page Could Not Verify
Two gaps are worth stating rather than papering over. The New York State Gaming Commission's own website returned a bot-protection interstitial on every attempt during this research, so nothing on the Commission's pages is quoted here; the Commission is identified from the statute and from the Attorney General's own press release instead. The helpline gap that used to sit here is closed: the New York State Office of Addiction Services and Supports publishes the state's own HOPEline, and its number, its text route and its hours are in the support section below, with that office's page as the source.
Why No Casinos Are Listed for New York
Real-money online casino play is prohibited in New York, so no casinos are listed here.
Sweepstakes Availability in New York
Sweepstakes casinos play for prizes under sweepstakes law rather than taking wagers, so their availability is a different question from whether New York licenses real-money casino play.
No sweepstakes casino has had its availability in New York recorded yet. Availability is stored per site and per state with a source and a date, so nothing appears here until it has been checked.
Online Casino Status by State
Real-money and sweepstakes status are tracked separately, and a dash means nobody has checked yet — not that nothing is permitted.
