Idaho prohibits gambling in its Constitution. Article III, Section 20 states that gambling is contrary to public policy and strictly prohibited except for a state lottery, pari-mutuel betting and charitable bingo and raffles, and it adds that none of those permitted activities may employ casino gambling or an electronic imitation of it. Idaho Code 18-3801 defines gambling to include risking money or credit on chance and names casino games expressly, and 18-3802 makes participating in gambling a misdemeanour. Idaho licenses no online casino. Tribal casinos operate in the state under federal compacts, and a tribal-state compact is not a state online casino licence.

Idaho Prohibits Gambling in Its Constitution

Idaho is not a state that has simply never got round to online casino legislation. Article III, Section 20 of its Constitution opens: “Gambling is contrary to public policy and is strictly prohibited except for the following:” Three exceptions follow, and the first is “A state lottery which is authorized by the state if conducted in conformity with enabling legislation; and” The other two are pari-mutuel betting and charitable bingo and raffle games. An online casino is not among them.

The same section limits what those permitted activities may look like: “No activities permitted by subsection (1) shall employ any form of casino gambling including, but not limited to, blackjack, craps, roulette, poker, bacarrat, keno and slot machines, or employ any electronic or electromechanical imitation or simulation of any form of casino gambling.” That sentence constrains the lottery, racing and charitable games rather than standing on its own, but it shows how firmly Idaho draws the line around casino-style play. The section also directs that “The legislature shall provide by law penalties for violations of this section.”

The Criminal Code Names Casino Games

Idaho Code 18-3801 defines the term: “"Gambling" means risking any money, credit, deposit or other thing of value for gain contingent in whole or in part upon lot, chance, the operation of a gambling device or the happening or outcome of an event, including a sporting event, the operation of casino gambling including, but not limited to, blackjack, craps, roulette, poker, bacarrat or keno, but does not include:” Two features matter for anyone reading about online play. The first is that the thing risked may be “credit” rather than cash. The second is that casino games are named rather than left to implication. Idaho Code 18-3802 then provides that “A person is guilty of gambling if he: (a) Participates in gambling; or” and that “Gambling is a misdemeanor.” No online casino is licensed in Idaho, and this site does not point readers at operators that are not licensed where they are.

Tribal Casinos Are a Separate Question

Idaho has significant tribal gaming, conducted on tribal land under federal law and tribal-state compacts. A compact is not a state licence and does not create a state-regulated online casino market. Nothing on this page should be read as describing tribal gaming, and tribal operations are not online casino licences.

No Sourced Position on Sweepstakes Casinos

Idaho has published no statute, rule, court decision or official opinion that this research could find addressing sweepstakes or dual-currency casinos by name, so this page records no sweepstakes status rather than inferring one. What Idaho law does contain is a narrow exclusion for promotional prize play: “Merchant promotional contests and drawings conducted incidentally to bona fide nongaming business operations, if prizes are awarded without consideration being charged to participants; or” It also excludes “Games that award only additional play; or” Those two exclusions describe a promotion run alongside a non-gaming business with nothing charged, and a game that pays only in further play. Reading a dual-currency casino product into or out of them is a legal judgement, not a sourced fact, and this page does not make it.

Sweepstakes casinos and real-money casinos are separate products with separate rules, and neither is presented here as a licensed version of the other.

Support in Idaho

The National Problem Gambling Helpline™ is operated by the National Council on Problem Gambling and can be reached on 1-800-MY-RESET by call or text, or by chat at 1800myreset.org. The NCPG publishes 1-800-MY-RESET as the national number on its own pages, and that is the number recorded here because it is the one the helpline operator itself publishes. Older state and industry materials sometimes print a different national number, so more than one is in circulation; where a state body publishes its own helpline, that number is shown alongside this one.
