Kansas licenses state-owned casinos and, since 2022, online sports wagering, but it licenses no online casino. The Kansas Racing and Gaming Commission states on its own site that the only lawful forms of gambling are the constitutional exceptions — charitable bingo and raffles, pari-mutuel racing, the state lottery including state-owned casino games — plus tribal gaming, and that every other type of gambling is illegal in Kansas. Making a bet is the offence of gambling under K.S.A. 21-6404, and the statutory list of things that are not a bet was amended in 2022 to add sports wagering. That is the whole difference between the verticals: Kansas created an "interactive sports wagering platform" category for wagering over the internet, while casino games remain defined as games played in a portion of a building. The minimum age is 21.

Kansas Licenses State-Owned Casinos, Not Online Casinos

Kansas is unusual in that the state itself owns the casino games, and the regulator is unusually direct about what follows. The Kansas Racing and Gaming Commission's own guidance lists the constitutional exceptions — charitable bingo, pari-mutuel racing, the state lottery including "casino-style gambling at Kansas casinos where the State owns the casino games and regulates the operation of the facility", and charitable raffles — and then says: "In addition, gambling at tribal casinos (casinos lawfully operated by Indian tribes) is legal in Kansas. Every other type of gambling is illegal in Kansas."

The statute matches. Under K.S.A. 21-6404 gambling is "(1) Making a bet; or" and "(2) entering or remaining in a gambling place with intent to make a bet, to participate in a lottery or to play a gambling device.", and running the operation is commercial gambling, which covers "(B) receiving, recording or forwarding bets or offers to bet or, with intent to receive, record or forward bets or offers to bet, possessing facilities to do so;". The definition of a bet carries a closed list of exclusions, and online casino play is not on it. Kansas casino games are venue-bound by definition: "(p) "Lottery gaming facility" means that portion of a building used for the purposes of operating, managing and maintaining lottery facility games." This site does not point readers at operators that are not licensed where they are.

Online Sports Betting Is Licensed, Online Casino Is Not

Kansas shows the difference between the verticals in a single statutory list. The things that are not a "bet" under K.S.A. 21-6403 include "(10) sports wagering, as defined in K.S.A. 74-8702 , and amendments thereto;", added in 2022. No comparable item exists for casino games played online.

The Expanded Lottery Act then built an internet category for sports wagering alone: "(j) "Interactive sports wagering platform" means an integrated system of hardware, software and applications, including, but not limited to, mobile applications and servers, through which sports wagering may be made available to persons physically located within the state of Kansas at the time of submitting the wager to a sports wagering manager over the internet or wireless services as defined in K.S.A. 66-2019 , and amendments thereto, including, but not limited to, through websites and mobile device applications." The two products are kept apart in the revenue definitions as well: "(2) "Lottery facility games" does not include sports wagering or historical horse race machines, as defined in K.S.A. 74-8802 , and amendments thereto." A reader using a licensed Kansas betting app should not infer that online slots or table games are licensed there, because they are not.

Sweepstakes Casinos: Why No Status Is Recorded

Kansas law contains statements that pull in both directions on prize play, and none of them is about an online dual-currency casino, so no sweepstakes status is recorded here. The Commission's own guidance addresses physical machines in shops and bars: "So-called “sweepstakes machines” and “phone card machines” are illegal gambling devices." That is a statement about a machine in a business establishment, not about a website, and it is reported here as what it is rather than extended to a different product.

Pulling the other way, the statutory definition of consideration excludes the no-purchase route: "Mere registration without purchase of goods or services; personal attendance at places or events, without payment of an admission price or fee; listening to or watching radio and television programs; answering the telephone or making a telephone call and acts of like nature are not consideration." Which of these governs an online sweepstakes casino is a question no Kansas statute, rule or official opinion read for this page answers. Sweepstakes casinos and real-money casinos are separate products and neither is presented here as a licensed version of the other.

Who Regulates, and the Minimum Age

Several bodies share the work, and the Commission sets out the split on its own site: "Kansas Racing and Gaming Commission: Regulates state owned casinos and licensed pari-mutuel racetracks in Kansas.", "Kansas Lottery Commission: Administers traditional lottery games, owns and operates state casino games." and "Lottery Gaming Facility Review Board: Created to select lottery gaming facility managers."

The minimum age is 21. The Expanded Lottery Act provides that "it is unlawful for any lottery gaming facility manager, or its employees or agents, to allow any person to play electronic gaming machines or lottery facility games at a lottery gaming facility or share in winnings of such person knowing such person to be: (1) Under 21 years of age;".

Support in Kansas

The National Problem Gambling Helpline™ is operated by the National Council on Problem Gambling and can be reached on 1-800-MY-RESET by call or text. The NCPG publishes 1-800-MY-RESET as the national number on its own pages, and that is the number recorded here because it is the one the helpline operator itself publishes. Older state and industry materials sometimes print a different national number, so more than one is in circulation; where a state body publishes its own helpline, that number is shown alongside this one. The helpline offers call, text and chat services 24/7/365 and its network covers all 50 states and the U.S. territories. The Kansas Racing and Gaming Commission runs a voluntary exclusion programme and a separate sports wagering exclusion programme.
