Online casino play is licensed in West Virginia, where the law calls it interactive wagering. The West Virginia Lottery Commission regulates it under the West Virginia Lottery Interactive Wagering Act, article 29-22E of the state code, and the operation of interactive wagering is lawful only when conducted under that article and the Commission's rules. Authorised interactive games include casino themed slot simulations and table games. The Lottery records that interactive wagering was enacted in Fiscal Year 2020 through House Bill 2934, which let existing racetrack casinos and the casino in a historic resort hotel offer it. A licensee may not let anyone under 21 take part. No status is recorded for sweepstakes casinos because no West Virginia law or regulator statement addresses them.

West Virginia licenses real-money online casino play, which the state code calls interactive wagering. It is regulated by the West Virginia Lottery Commission under article 29-22E of the state code, the West Virginia Lottery Interactive Wagering Act.

Who Regulates Online Casino Play in West Virginia

The Act is explicit about where the authority comes from and where it stops: the operation of interactive wagering and ancillary activities are only lawful when conducted in accordance with the provisions of the article and the rules of the commission. The commission in question is defined in the Act as the West Virginia Lottery Commission. The Legislature's own findings record that the state constitution gives West Virginia the exclusive right to own and operate a lottery, and that interactive wagering is run as a form of that lottery.

The licensed market is deliberately narrow. The Legislature decided the most effective way to regulate was to limit the number of authorised operators to the racetracks licensed to run video lottery terminals and the historic resort hotel. The West Virginia Lottery records that interactive wagering, or iGaming, was enacted in Fiscal Year 2020 when the Legislature passed House Bill 2934, permitting existing racetrack casinos and the casino in a historic resort hotel to offer wagering on any authorized interactive gaming provider.

Which Games Are Covered

The Act defines gaming, or interactive gaming, as wagering on any authorized interactive game, and says authorised interactive games are computerised or virtual versions of any game of chance or digital simulation of one, including casino themed slot simulations, table games and other games approved by the commission. Interactive wagering itself is defined as placing wagers remotely and in real time on an authorised interactive game with an interactive gaming provider, by any communications technology.

Age and Location Requirements

The age limit for interactive wagering is 21. The Act makes it an offence where a licensee knowingly permits an individual under the age of 21 to enter or remain in a designated gaming area or to engage in interactive wagering. This is a different limit from the lottery's general one: the West Virginia Lottery prints on its own site that a player must be 18 years or older to play.

Wagers must originate in the state. A licensee must ensure that interactive wagering occurs only in the specific locations within designated gaming areas approved by the commission, or using a commission approved mobile application or other digital platform that uses communications technology to accept wagers originating within West Virginia.

Unlicensed Operators

Running an interactive wagering operation without a licence is a crime in West Virginia. Any person other than a licensee under the article who engages in accepting, facilitating or operating an interactive wagering operation is guilty of a misdemeanour, with a fine of up to $10,000 or up to 90 days in jail, or both; a third or subsequent conviction is a felony. The Legislature recorded that illegal interactive wagering channels operating throughout the United States pose a critical threat to the safety and welfare of West Virginians. This site does not list or recommend unlicensed operators.

Sweepstakes Casinos in West Virginia

This page records no status for sweepstakes casinos in West Virginia, because no West Virginia statute and no statement by the Lottery Commission found for this page addresses them either way. What can be said is narrower and sourced: the only interactive wagering West Virginia licenses runs through its licensed gaming facilities, meaning the racetracks and the historic resort hotel, and a sweepstakes casino is not one of those and is not a licensed alternative to one.

Problem Gambling Help in West Virginia

West Virginia has its own programme behind 1-800-GAMBLER, run by First Choice Services. On its own site the programme says it has helped thousands of West Virginians overcome gambling addiction since it began in 2000, that it provides crisis counselling, treatment and resources, that all its services are free, and that its helpline coordinators are available 24 hours a day, seven days a week. It also runs prevention and training work and offers a free recovery support app with peer support. The West Virginia Lottery prints the same number as the Problem Gambling Helpline. Separately, the National Council on Problem Gambling brands the national helpline 1-800-MY-RESET on its own pages.
