Not trackedOnline gambling is an offence in Thailand. The Anti-Fake News Center Thailand, in a knowledge-base item whose verifying agency is the Central Division of the Office of the Permanent Secretary for Justice, states that those who organise online gambling — site owners, site managers, system administrators, marketers and promoters, and bank-account holders who knowingly let accounts be used — commit an offence punishable by up to two years' imprisonment or a fine of up to 2,000 baht or both, and that providing gambling by electronic media is a predicate offence under the Anti-Money Laundering Act B.E. 2542. The governing statute is the Gambling Act B.E. 2478 (1935), which the Fiscal Policy Office describes as prescribing the criteria and types of gambling that may be provided or played, with a Royal Decree of 10 July 1939 under section 4 allowing certain gambling only at a government casino established by the Minister of Finance. A draft Entertainment Complex Business Act that would license a casino inside an integrated entertainment complex went to public consultation from 1 to 17 August 2024; it is a draft bill, its casino definition is premises-based, and its subsequent parliamentary stage could not be verified at primary source. No Thai body licenses or supervises online casino play.
The Legal Position
Online gambling is an offence in Thailand, and a Thai government source says so about online play specifically rather than leaving it to be read across from a land-based rule.
The Anti-Fake News Center Thailand publishes a knowledge-base item headed "จัดให้เล่นพนันออนไลน์ เสี่ยงติดคุก!" — organising online gambling risks prison (translation) — dated 6 March 2024, which names its verifying agency on the page as "กองกลาง สำนักงานปลัดกระทรวงยุติธรรม", the Central Division of the Office of the Permanent Secretary for Justice, under the heading "หน่วยงานที่ตรวจสอบ". It identifies who commits the offence: "กลุ่มผู้จัดให้มีการเล่นการพนันออนไลน์ ทั้งเจ้าของเว็บไซต์ ผู้บริหารจัดการเว็บไซต์ ผู้ดูแลระบบ (แอดมิน) ผู้ทำการตลาด หรือโปรโมทเว็บไซต์ เจ้าของบัญชีธนาคารที่ยินยอมรู้เห็นเป็นใจเปิดบัญชี" — the group organising online gambling: website owners, site managers, system administrators, marketers or promoters of the site, and bank-account holders who knowingly consent to an account being opened (translation). And it states the consequence: "มีความผิดตามกฎหมาย โทษจำคุกไม่เกิน 2 ปี หรือปรับไม่เกิน 2,000 บาท หรือทั้งจำทั้งปรับ" — an offence under the law, punishable by imprisonment of up to 2 years or a fine of up to 2,000 baht or both (translation).
The money-laundering dimension is set out next: "นอกจากนี้ การจัดให้มีการเล่นการพนันทางสื่ออิเล็กทรอนิกส์ ยังเป็นหนึ่งในมูลฐานความผิด ตามพระราชบัญญัติป้องกันและปราบปรามการฟอกเงิน พ.ศ. 2542" — providing gambling through electronic media is also one of the predicate offences under the Anti-Money Laundering Act B.E. 2542 (translation) — with a penalty of "จำคุกตั้งแต่ 1 ปี ถึง 10 ปี หรือปรับตั้งแต่ 20,000 บาท ถึง 200,000 บาท" and the possibility of related assets being seized or frozen.
The Governing Statute
The statute is the Gambling Act B.E. 2478, which is 1935. Its own text is not quoted here, because no official Thai text of it was sourced.
The Fiscal Policy Office, in its own consultation paper, lists the three instruments nearest to a casino business. The second is "2) พระราชบัญญัติการพนัน พ.ศ. 2478 ซึ่งได้กำหนดหลักเกณฑ์และประเภทการพนันที่อนุญาตให้มี หรือเข้าเล่น หรือเข้าพนันได้ และ" — the Gambling Act B.E. 2478, which prescribes the criteria and the types of gambling that may be provided, played or wagered on (translation). The third is the Royal Decree on gambling conditions under section 4 of that Act: "3) พระราชกฤษฎีกาว่าด้วยเงื่อนไขการพนัน ตามมาตรา 4 แห่งพระราชบัญญัติการพนัน พ.ศ. 2478 (ฉบับที่ 2) มีผลบังคับใช้ตั้งแต่วันประกาศในราชกิจจานุเบกษา (ประกาศ ณ วันที่ 10 กรกฎาคม 2482) โดยมาตรา 4 ของพระราชกฤษฎีกาฉบับนี้ ระบุว่า การพนันบางรายการจะจัดให้มี เข้าเล่น หรือเข้าพนันได้ ณ สถานกาสิโนของรัฐบาล ซึ่งรัฐมนตรีว่าการกระทรวงการคลังจัดตั้งขึ้น" — in force from its publication in the Royal Gazette on 10 July 1939, and providing that certain gambling may be provided, played or wagered on at a government casino established by the Minister of Finance (translation).
No Regulator
No Thai body licenses or supervises online casino play, and this page names none. A site advertising a Thai online casino licence is not describing anything that exists in Thai law.
The Entertainment Complex Bill: A Bill, and About a Building
A draft Entertainment Complex Business Act was put to public consultation on ระบบกลางทางกฎหมาย, the official central legal system of the Office of the Council of State, under the title "การรับฟังความคิดเห็นต่อร่างพระราชบัญญัติการประกอบธุรกิจสถานบันเทิงครบวงจร พ.ศ. ....", in the window "01 ส.ค. 67 - 17 ส.ค. 67" — 1 to 17 August 2024.
The consultation paper describes the draft: "ร่างพระราชบัญญัติการประกอบสถานบันเทิงครบวงจร พ.ศ. .... ประกอบด้วย 9 หมวด 65 มาตรา โดยกำหนดให้ “สถานบันเทิงครบวงจร” หมายความว่า การประกอบธุรกิจสถานบันเทิงตามบัญชีแนบท้ายพระราชบัญญัตินี้หลายประเภทรวมกัน ร่วมกับกาสิโน และกำหนดให้ “กาสิโน” หมายความว่า การจัดให้มีการเข้าเล่นหรือการเข้าพนันในสถานที่ที่กำหนดเป็นการเฉพาะ" — nine chapters and 65 sections, defining an integrated entertainment complex as several categories of entertainment business operated together with a casino, and defining "casino" as the provision of play or wagering in a specifically designated place (translation). It would create a policy committee chaired by the Prime Minister, an executive committee and a supervising office, with the policy committee deciding the number of licences, the permitted areas, the proportion of a complex given over to the casino, registration arrangements and entry fees for Thai nationals.
Two things follow, and both matter for a reader looking for an online route. First, this is a draft bill described at the consultation stage, and this page says nothing about what became of it, because no Thai government page that could be read records a later stage. Second, even as drafted it is not an online casino route: its casino is a place.
The Other Bill: A Tightening
A draft Gambling Act (Amendment) Bill went to consultation on the same official system in the window "29 ม.ค. 68 - 13 ก.พ. 68" — 29 January to 13 February 2025. Its stated background is worth reading because it is the Thai state's own account of the online problem: "พระราชบัญญัติการพนัน พุทธศักราช ๒๔๗๘ ได้ใช้บังคับมานานมีบทบัญญัติบางมาตราล้าสมัยและมีอัตราโทษที่ไม่สอดคล้องกับสภาวการณ์ในปัจจุบันที่การเล่นพนันได้พัฒนาวิธีการเล่นซับซ้อนมากขึ้น มีการนําเทคโนโลยีสมัยใหม่เข้ามาใช้ในรูปแบบที่หลากหลาย โดยเฉพาะมีการใช้เครื่องมือทางอิเล็กทรอนิกส์เข้ามาเป็นสื่อกลางในการเล่น ทำให้ยากต่อการควบคุม และบังคับใช้กฎหมาย" — the Act has been in force a long time, some provisions are outdated and the penalties out of step with a present in which play has grown more complex and modern technology, particularly electronic tools used as the medium of play, makes control and enforcement difficult (translation).
Its first stated principle is "(1) กำหนดห้ามมิให้อนุญาตจัดให้มี หรือเข้าเล่น หรือเข้าพนันออนไลน์ในการเล่นอันระบุไว้ในบัญชี ก. และบัญชี ข. เว้นแต่ได้รับอนุญาตจากเจ้าพนักงาน" and its second "(2) กำหนดโทษของผู้จัดให้มีการเล่นการพนันและพนันออนไลน์ หรือผู้ควบคุมระบบ และผู้เข้าเล่นการพนันและพนันออนไลน์ให้เหมาะสมแก่สภาพและความร้ายแรงแห่งความผิด" — to prohibit authorising, playing or wagering online on the games in Schedules A and B except with an official's permission, and to set penalties on organisers, system controllers and players of gambling and online gambling proportionate to the gravity of the offence (translation). Both are proposals in a draft, and they are described as such; what they show is the direction of the Thai state's own reform thinking, which is towards tightening the online position rather than licensing it.
What This Means for a Reader in Thailand
No operator is listed on this page for Thailand, because the market prohibits online gambling. Overseas sites exist that will take players from many countries and some of them will take a player in Thailand; that is a fact about those sites, not a lawful route, and the Thai material above puts the offence on the organisers, the administrators, the promoters and the people who lend bank accounts to the operation.
No Thai problem-gambling helpline is printed here, because none was read on an operating body's own site.
What Is Available Instead
Almost nothing this page can establish. The Gambling Act B.E. 2478 prescribes the types of gambling that may be provided, and a Royal Decree in force since 10 July 1939 provides that certain gambling may be provided only at a government casino established by the Minister of Finance — but this page does not establish that such a casino exists or is open. A draft integrated entertainment complex bill went to consultation and what became of it could not be established from any Thai government page.
