Nepal regulates land-based casinos through the Department of Tourism, under the Ministry of Culture, Tourism and Civil Aviation, which was formed in 2071 BS to oversee tourism-industry regulation including casinos and five-star hotels, and which operates a casino registration system and issues anti-money-laundering guidance to casinos. The current instrument is the Casino Rules, 2082, which the Department and the Nepal Law Commission both publish as a PDF. The Inland Revenue Department treats casino winnings as a windfall gain taxed at 25 per cent. No Nepali primary source read addresses online casino play in Nepal, so this page states no legal position on it, names no online regulator, and lists no operator.

What This Page Can and Cannot Say

This page states no legal position on online casino play in Nepal, because no Nepali official source addresses it. That is a finding, not a gap left by haste: the Department of Tourism and the tourism ministry that between them regulate casinos, the Nepal Law Commission's index of Acts in force, the Inland Revenue Department, the Nepal Telecommunications Authority and Nepal Rastra Bank publish nothing on online casino play, online gambling or internet betting. So no casino status is recorded for this market, which asserts nothing in either direction, and no operator is listed for Nepal.

One thing about the sources also shaped this page. Every Nepali instrument that bears on casinos — the Casino Rules, 2082, the earlier Casino Rules, 2070, the Tourism Act, 2035 and the Criminal Code, 2074 — is published as a PDF, and no provision of any of them is quoted below. What is quoted is what the responsible bodies say on their own web pages.

Who Regulates Casinos

Casinos sit with the Department of Tourism, under the Ministry of Culture, Tourism and Civil Aviation, and the Department names them in its own account of why it exists. Its Introduction page explains that the Department was formed because “ठूला पर्यटन उद्योगहरु जस्तो पाँचतारे होटलहरु, क्यासिनो, स्वदेश विदेशमा पर्यटन प्रबर्द्धन, पर्वतारोहण अनुमति र पर्वतीय पर्यटनको एकीकृत विकास जस्ता कार्य विभागको तहबाट गर्नु उपयुक्त हुने भएकोले” — because it was appropriate for work on large tourism industries such as five-star hotels and casinos, on tourism promotion at home and abroad, on mountaineering permits and on the integrated development of mountain tourism to be carried out at departmental level (translation). The same sentence sets out the remit it was given: “पर्यटन पूर्वाधार विकास, पर्यटन उद्योगहरुको नियमन, पर्यटन प्रबद्र्धन र विकास, पर्यटक प्रहरीको व्यवस्थापन र मातहतका पर्यटन कार्यालयहरु समेत हेर्ने गरी नेपाल सरकार (मन्त्रिपरिषद्) मिति २०७१।०४।०२ को निर्णयानुसार पर्यटन विभागको गठन भएको हो” — tourism infrastructure development, the regulation of tourism industries, tourism promotion and development, management of the Tourist Police and the subordinate tourism offices, pursuant to a decision of the Government of Nepal (Council of Ministers) dated 2071.04.02 (translation).

What that describes is land-based tourism-industry regulation. The Department runs a क्यासिनो दर्ता व्यवस्थापन प्रणाली — a casino registration management system — and publishes AML/CFT Guidance to Casinos and a 2082 guidance document on risk-based on-site inspection and off-site supervision of casinos. Those are page titles and system names rather than sentences, so they are described here and not quoted. Nothing in the Department's published remit extends to online play.

The Governing Rules

The current instrument is the Casino Rules, 2082 (क्यासिनो नियमावली, २०८२), dated 21 Bhadra 2082 on the Department's publication page and also carried by the Nepal Law Commission. The earlier Casino Rules, 2070 are also carried by Koshi Province's Ministry of Tourism, Forests and Environment, which labels them federal rules rather than provincial ones — an indication, though not proof, that casino regulation is federal rather than provincial.

One further observation belongs here with its limits stated. The Nepal Law Commission's alphabetical index of Acts in force, read in full, contains no entry for a Gambling Act. That is an absence from an index, not a statement of law, and it is recorded that way: it does not establish that no gambling offence exists, and gambling offences may well sit within the Criminal Code, 2074, which is not quoted here either.

Taxation of Winnings

The one Nepali authority that addresses casino play on its own web pages is the Inland Revenue Department, in its published FAQ. Asked whether an amount received on winning while gambling in a casino falls within windfall gains, it answers that it does, and states that income tax is levied at 25 per cent on the payment received on windfall gains such as casino winnings, lottery and prize money (translation). The same answer lists the windfall-gain sources as including gambling, lottery, betting, gifts, donations, intestate inheritance, informant rewards and prizes.

That establishes that the Nepali state recognises and taxes casino gambling winnings. It says nothing about whether the game was played in a venue or on a website, and it is not used here as evidence either way.

What Is Not Printed, and Why

No problem-gambling helpline is printed: no Nepali body publishes one on any page read for this market. No sweepstakes position is recorded: nothing read addresses that model. No sub-national licensing is recorded: the only provincial page found republishes the federal Casino Rules rather than licensing separately.

FAQ

Nepal Online Casino FAQs

Is Online Casino Play Legal in Nepal?
This page does not say, and that is deliberate. No Nepali primary source read addresses online casino play — not the Department of Tourism, not the Ministry of Culture, Tourism and Civil Aviation, not the Nepal Law Commission's index of Acts in force, not the Inland Revenue Department, not the Nepal Telecommunications Authority and not Nepal Rastra Bank. Leaving the status empty claims nothing either way, and no operator is listed for Nepal as a result. A page that asserted a position here would be inventing one.
Who Regulates Casinos in Nepal?
The Department of Tourism, under the Ministry of Culture, Tourism and Civil Aviation. Its own Introduction page records that it was formed by a Council of Ministers decision of 2071.04.02 BS so that work on large tourism industries such as five-star hotels and casinos could be done at departmental level, and that its functions include the regulation of tourism industries. The Department operates a casino registration management system and publishes anti-money-laundering and counter-terrorist-financing guidance to casinos. Its remit as described is land-based tourism-industry regulation; nothing in it mentions online play.
What Rules Govern Casinos?
The Casino Rules, 2082, which the Department of Tourism and the Nepal Law Commission both publish. Both publish them as a PDF, and no provision of the Rules is quoted on this page. The Department also publishes a 2082 guidance document on risk-based on-site inspection and off-site supervision of casinos.
Are Casino Winnings Taxed?
Yes. The Inland Revenue Department's own FAQ states that an amount won while gambling in a casino falls under windfall gains, and that income tax is levied at 25 per cent on the payment received on windfall gains such as casino winnings, lottery and prize money. The same answer lists gambling, lottery, betting, gifts, donations, intestate inheritance, informant rewards and prizes as windfall-gain sources. The FAQ says nothing about the channel through which the game is played.
Is There a Nepali Gambling Act?
None appears in the Nepal Law Commission's alphabetical index of Acts in force. That is an absence from an index rather than a positive statement of law, and it is recorded here as such: it is not evidence that no gambling offence exists, and gambling offences may sit in the Criminal Code, 2074, which the Commission publishes as a PDF.
Is There a Minimum Gambling Age?
No Nepali primary source read states one, so this page prints none. Any age rule would sit in the Casino Rules, 2082.
Does Nepal Have a Sweepstakes Casino Category?
This page does not say, because no Nepali source read addresses the dual-currency sweepstakes casino model.
