Online Casinos in Kazakhstan

The Legal Position

Online casino play is prohibited in Kazakhstan, and the prohibition names the product rather than catching it incidentally. The governing statute is the Law of the Republic of Kazakhstan of 12 January 2007 No. 219 'On gaming business', published on Әділет, the official legal information system of the Republic of Kazakhstan. Article 6(2) opens a list with "2. На территории Республики Казахстан запрещаются:" — the following are prohibited on the territory of the Republic of Kazakhstan (translation) — and the second item on that list is "2) деятельность электронного казино и интернет-казино;" — the activity of an electronic casino and an internet casino (translation).

Article 1(4-1) supplies the definition the ban attaches to: "интернет-казино – интернет-ресурс, реализующий возможность организации и проведения азартных игр в режиме реального времени посредством сети Интернет и (или) электронных денег и предусматривающий получение выигрыша" — an internet resource providing the possibility of organising and conducting games of chance in real time by means of the Internet and/or electronic money, and providing for the receipt of winnings (translation). That is the product an online casino is.

Foreign sites are addressed in the same list. Item 2-1 prohibits "интернет-ресурсы иностранных букмекерских контор и тотализаторов, не имеющих лицензий на право занятия деятельностью в сфере игорного бизнеса в Республике Казахстан" — the internet resources of foreign bookmakers and totalisators holding no Kazakh gaming-business licence (translation).

The Supervising Body

The Law assigns the sector to an "уполномоченный орган", which Article 1(13) defines as "государственный орган, определяемый Правительством Республики Казахстан, осуществляющий реализацию государственной политики и контроль в сфере игорного бизнеса" — a state body determined by the Government that implements state policy and control in the sphere of gaming business (translation). Among that body's listed functions is "5) выдает лицензии на право занятия деятельностью в сфере игорного бизнеса в Республике Казахстан" — it issues licences for the right to engage in gaming-business activity (translation).

The body is the Committee for the Regulation of Gaming Business and Lottery of the Ministry of Tourism and Sports of the Republic of Kazakhstan, which describes itself on its own gov.kz page as an agency of that Ministry "осуществляющим руководство в сферах игорного бизнеса, лотереи и лотерейной деятельности" — exercising leadership in the spheres of gaming business, lottery and lottery activity (translation). The Ministry records that the Committee was "созданный 4 сентября 2024 года в соответствии с постановлением Правительства РК" — created on 4 September 2024 pursuant to a Government resolution (translation).

This page names no online casino regulator, because there is none to name. The Committee licenses the land-based activities the Law permits; it does not license online casino play, and no Kazakh body does.

What Is Permitted, and Where

Kazakhstan's permitted gambling is land-based and geographically confined. Article 11(1) provides that casinos, slot-machine halls, bookmakers and totalisators "подлежат размещению на территориях, определяемых Правительством Республики Казахстан" — are to be located on territories determined by the Government (translation) — and that "Границы территорий для размещения казино, залов игровых автоматов, букмекерских контор и тотализаторов (касс букмекерских контор и (или) тотализаторов) определяются местными исполнительными органами по согласованию с уполномоченным органом." Local executive bodies set the boundaries of those zones in agreement with the central body; they do not license operators. Article 11(2) makes locating any of those venues outside the designated territories prohibited.

Enforcement Against Internet Casinos

There is a statutory referral route from monitoring to blocking. Article 12-2(7) requires the legal entity running the unified accounting system, on the results of monitoring to identify internet resources bearing the signs of an internet casino or of unlicensed bookmakers and totalisators, to send the authorised body in the field of mass media the domain names, page indicators and network addresses identifying those sites, "для ограничения доступа к ним на территории Республики Казахстан в порядке, установленном законодательством Республики Казахстан". The Committee itself is charged with "систематический сбор информации и анализ содержания интернет-ресурсов на предмет наличия признаков интернет-казино" (translation: systematic collection of information and analysis of the content of internet resources for the presence of signs of an internet casino).

The Ministry of Tourism and Sports recorded on 28 October 2024 that the Committee "обновил список Интернет-ресурсов, не имеющих лицензии на предмет занятия деятельностью в сфере игорного бизнеса" and that "В него вошли 1820 уникальных адресов, содержащих признаки интернет-казино, что запрещено пунктом 2 статьи 6 Закона РК." — 1,820 unique addresses bearing the signs of an internet casino, prohibited by Article 6(2) (translation). Findings are "вносится в информационную систему «Кибернадзор»" for legal assessment and access restriction.

Age and Exclusion

Article 15(1) bars participation in games of chance and betting, and the first category it names is "физических лиц в возрасте до двадцати одного года" — natural persons under twenty-one (translation). The same Article extends the bar to people restricted by a court, people who have restricted themselves, people entered in the Unified Register of Debtors, and people under sentences of restriction of liberty or suspended sentences. Article 12-2 gives the authorised body the duty of maintaining "список лиц, ограниченных в участии в азартных играх и (или) пари" — the list of persons restricted from participation (translation).

What This Means for a Reader in Kazakhstan

No operator is listed on this page for Kazakhstan, because internet casinos are prohibited there by name. Overseas sites exist that will take players from many countries, and the Committee's own figure of 1,820 monitored addresses indicates how many are reachable; that is a fact about those sites and about Kazakh enforcement, not a lawful route. No Kazakh problem-gambling helpline is printed here, because none was read on any government body's own site.

What Is Available Instead

Land-based gambling, in designated areas only. Four activities are licensable — casinos, slot-machine halls, bookmakers and totalisators — all of them land-based, licensed centrally by the Committee for the Regulation of Gaming Business and Lottery, and located only on territories determined by the Government. Locating them anywhere else in Kazakhstan is prohibited, the minimum age is 21, and the internet resources of foreign bookmakers holding no Kazakh licence are blocked.
