About DANA

What DANA Is

DANA is an Indonesian mobile payment service. Its own terms describe it as payment services in the form of electronic money, an electronic wallet, transfer and other supporting services, used from a telecommunications device, and describe the DANA application as a platform provided by PT Aliansi Teknologi Indonesia carrying several service features, among them DANA as a payment system service. It is used for merchant payments, transfers between DANA accounts and to banks, and bill payments, and it also fronts a payment gateway for merchants.

Who Operates It and Who Licenses It

DANA's terms state that the service is established by PT Espay Debit Indonesia Koe, abbreviated in the terms to EDIK, as the holder of an authorised licence as a Payment System Provider Category I. The terms set out what that licence covers: account issuance services including electronic money issuance, payment initiation and acquiring services including electronic wallet provision, payment gateway provision and acquirer services, and remittance services as well as digital financial services. The granting authority named is Bank Indonesia. The terms also provide that where a dispute cannot be settled by deliberation the user may complain to a dispute settlement institution or to Bank Indonesia, and that “If the methods above are not successful, then the dispute shall be resolved through the South Jakarta District Court.”

Lawful Purpose Is a Condition of Use

DANA's terms carry a representation and warranty clause rather than a list of banned merchant categories. The user represents and ensures that the funds used in a transaction do not belong to any criminal or prohibited act under Indonesian law, that the DANA account was not opened for money laundering or terrorist financing, that the transaction is not intended to deceive, cover or avoid reporting to the Financial Transaction Reports and Analysis Center, and that transactions are not conducted to make payments for transactions whose object is in violation of the laws and regulations in force in the Republic of Indonesia. That last limb is the one that matters for a gambling payment, because of what Indonesian law says.

Online gambling is prohibited in Indonesia. A public advisory from the Ponorogo district prosecutor's office, one of Indonesia's local Kejaksaan Negeri offices, states that online gambling is a serious criminal offence carrying heavy penalties, and the Ministry of Communication and Digital Affairs has reported handling 4.1 million items of gambling content in Indonesia's digital space. That advisory is a local office speaking for its own district rather than a national statement from the Attorney General's Office. OCS records the statutes, the penalties and the dates on its country page for Indonesia. For a payment page the point is narrow and worth stating plainly: a rail existing in a market is not the same as that rail being usable for gambling in it, and DANA's lawful-purpose warranty points the same way as the law does. The only licence DANA's terms name is an Indonesian one, so a casino deposit made with DANA is a payment inside the market that prohibits the activity.

Fees and Timings

No fee and no timing figure is given. DANA publishes merchant pricing through a calculator rather than as a stated figure, and no consumer fee or settlement window for a merchant payment is published at all. Neither is estimated.
